Supporting and maintaining a safe environment for children is one of the most important elements of the early years practitioner's work.

In a safe environment, the risk of a child or adult becoming ill or getting injured is low. Parents need to know that their children are being kept safe while at the setting.

There are specific laws that ensure the safety of the child as well as that of the practitioner. The legislation relevant to health and safety in a childcare setting is the Health and Safety at Work Act 1974 (HASAWA) and the Children Act 1989.

HASAWA applies to all workplaces, including restaurants, shops etc. It was designed to protect employees in the workplace and applies to settings with 5 or more employees. The act specifies duties that employers and employees must fulfil. It states that all employees must follow the setting's health and safety procedures and use the safety equipment provided. In a childcare setting, this would mean that if someone had shown you how to pick up a baby or young child safely, you would have to follow this procedure and you should wear the safety equipment provided, such as disposable aprons and gloves.

HASAWA also states that employees have a duty to report anything they notice that could be a potential health and safety issue, and that they must not put others at risk through their own actions. The employer must ensure that all possible steps have been taken to minimize risk to the health and safety of all at the setting. The employer must do this by ensuring that a written policy is available explaining how risks are managed at the setting; that all staff receive training and protection and that risk assessments are carried out at the settings.

The acts state that Government must produce guidance for the legislation, known as Regulations. All settings are inspected by a Government organisation against these Regulations, and are required to have written policies and procedures. Policies are written documents outlining how the setting complies with legislation; procedures are what staff must follow in different circumstances.

The following are examples of regulations under HASAWA you will see in a childcare setting:

  • Control of Substances Hazardous to Health (COSHH) Regulations 2004:

    These determine how chemicals such as bleaches and cleaning products are used and stored and how the disposal of nappies is managed within settings. The setting's written procedures would state that bleaches and cleaning products must be kept in a locked cupboard.

  • Reporting of Injuries, Diseases and Dangerous Occurrences Regulations (RIDDOR) 1995:

    The setting must have an accident report book for employees and the Children Act 1989 states that there must also be an accident book for recording injuries to children. If an employee receives an injury that means they are unable to work for 3 days or more, the Health and Safety Executive (HSE) must be informed of this injury.

  • Fire Precautions (Workplace) Regulations 1997:

    All settings must show how they would evacuate the building and how they carry out fire drills. The setting must also have fire safety signs and instructions in every room.

  • Health and Safety (First Aid) Regulations 1981:

    All settings are required to have a first aid box and appoint at least one trained first-aider to take on the responsibility should there be an accident. The Children Act 1989 states that any medication administered to children must be recorded clearly.

    The Children Acts of 1989 and 2004 specify how the well-being of the child must be protected. The Act states that all childcare providers must comply with the National Regulations and Standards. The National Standards address all the different types of provision, such as full day care, sessional day care, childminding and after school care. Settings are inspected by the regulatory body Care Inspectorate Wales (CIW) in order to ensure that they comply with the standards. The National Standards deal with all aspects of childcare, including safety, food and drink and child protection. There are 24 Standards for Full Day Care in Wales. The setting will have policies and procedures covering all of these standards. Failing to follow these policies and procedures could put children and other adults at risk, and could lead to the early years worker being disciplined and possibly dismissed.

Mae deddfau penodol sy’n sicrhau diogelwch y plentyn yn ogystal â diogelwch yr gweithiwr gofal plant. Y ddeddfwriaeth sy'n berthnasol i iechyd a diogelwch mewn lleoliad gofal plant yw Deddf Iechyd a Diogelwch yn y Gwaith 1974 a Deddf Plant 1989.

Mae'r Ddeddf Iechyd a Diogelwch yn y Gwaith yn berthnasol i bob gweithle, gan gynnwys bwytai, siopau etc. Fe'i lluniwyd i warchod gweithwyr cyflogedig yn y gweithle ac mae'n berthnasol i leoliadau sy'n cyflogi 5 neu ragor o bobl. Mae'r ddeddf yn pennu dyletswyddau y mae'n rhaid i gyflogwyr a gweithwyr cyflogedig eu dilyn. Mae'r ddeddf yn datgan bod rhaid i bob gweithiwr cyflogedig ddilyn gweithdrefnau iechyd a diogelwch y lleoliad a defnyddio'r offer diogelwch a ddarperir. Mewn lleoliad gofal plant, byddai hyn yn golygu, pe bai rhywun wedi dangos i chi sut i godi babi neu blentyn bach yn ddiogel, byddai'n rhaid i chi ddilyn y weithdrefn hon, a dylech wisgo'r offer diogelwch a ddarperir, megis ffedogau a menig tafladwy.

Mae'r ddeddf hefyd yn datgan ei bod hi'n ddyletswydd ar weithwyr cyflogedig i ddweud am unrhyw beth y maent yn sylwi arno a allai fod yn fater iechyd diogelwch posibl, ac na ddylent beryglu eraill drwy eu gweithredoedd hwy eu hunain. Rhaid i'r cyflogwr wneud yn siŵr bod pob cam posibl wedi'i gymryd i achosi cyn lleied o risg â phosib i iechyd a diogelwch pawb yn y lleoliad. Rhaid i'r cyflogwr wneud hyn drwy sicrhau bod polisi ysgrifenedig ar gael sy'n esbonio sut mae risgiau'n cael eu rheoli yn y lleoliad; bod yr holl staff yn cael hyfforddiant a gwarchodaeth a bod asesiadau risg yn cael eu cyflawni yn y lleoliadau.

Mae'r deddfau'n datgan bod rhaid i’r Llywodraeth gynhyrchu canllawiau ar gyfer y ddeddfwriaeth, a gelwir y rhain yn Rheoliadau. Mae pob lleoliad yn cael ei arolygu gan un o sefydliadau'r Llywodraeth yn erbyn y Rheoliadau hyn, ac mae'n ofynnol eu bod yn meddu ar bolisïau a gweithdrefnau ysgrifenedig. Polisïau yw dogfennau ysgrifenedig sy'n amlinellu sut mae'r lleoliad yn cydymffurfio â deddfwriaeth; gweithdrefnau yw'r hyn y mae'n rhaid i staff eu dilyn mewn gwahanol amgylchiadau.

Dyma enghreifftiau o reoliadau dan Ddeddf Iechyd a Diogelwch yn y Gwaith 1974 y byddwch yn eu gweld mewn lleoliad gofal plant:

  • Rheoliadau Rheoli Sylweddau Peryglus i Iechyd (COSHH) 2004:

    Mae'r rhain yn pennu sut mae cemegau megis canyddion a chynhyrchion glanhau yn cael eu defnyddio a'u storio a sut mae gwaredu clytiau babis yn cael ei reoli yn y lleoliadau. Byddai gweithdrefnau ysgrifenedig y lleoliad yn datgan bod rhaid i ganyddion a chynhyrchion glanhau gael eu cadw dan glo mewn cwpwrdd.

  • Rheoliadau Adrodd ar Anafiadau, Clefydau neu Ddigwyddiadau Peryglus (RIDDOR) 1995:

    Rhaid i'r lleoliad feddu ar lyfr cofnodi damweiniau ar gyfer y gweithwyr cyflogedig ac mae Deddf Plant 1989 yn datgan bod rhaid hefyd cael llyfr damweiniau i gofnodi anafiadau i blant. Os bydd gweithiwr cyflogedig yn cael anaf sy'n golygu nad yw'n gallu gweithio am dri diwrnod neu ragor, rhaid i'r Awdurdod Gweithredol Iechyd a Diogelwch gael gwybod am yr anaf hwn. http://www.hse.gov.uk/cymraeg/

  • Rheoliadau Rhagofalon Tân (Gweithle) 1997:

    Rhaid i bob lleoliad ddangos sut y byddent yn gwacáu'r adeilad a sut y byddent yn cynnal ymarferion tân. Rhaid i'r lleoliad hefyd feddu ar arwyddion a chyfarwyddiadau diogelwch tân ym mhob ystafell.

  • Rheoliadau Iechyd a Diogelwch (Cymorth Cyntaf) 1981:

    Mae'n ofynnol bod gan bob lleoliad flwch cymorth cyntaf a'u bod yn penodi o leiaf un unigolyn sydd wedi'i hyfforddi fel swyddog cymorth cyntaf i ysgwyddo cyfrifoldeb pe bai damwain yn digwydd. Mae Deddf Plant 1989 yn datgan bod rhaid i unrhyw feddyginiaethau a roddir i blentyn gael eu cofnodi'n glir.

    Mae Deddfau Plant 1989 a 2004 yn dynodi sut mae'n rhaid diogelu lles y plentyn. Mae'r Ddeddf yn datgan bod rhaid i bob darparwr gofal plant gydymffurfio â'r Rheoliadau a Safonau Cenedlaethol. Mae'r Safonau Cenedlaethol yn rhoi sylw i'r holl wahanol fathau o ddarpariaeth, megis gofal diwrnod llawn, gofal dydd sesiynol, gwarchod plant a gofal ar ôl ysgol. Mae lleoliadau'n cael eu harolygu gan y corff rheoleiddio, sef Arolygiaeth Gofal Cymru (AGC) i wneud yn siŵr eu bod yn cydymffurfio â'r safonau. Mae'r Safonau Cenedlaethol yn delio â phob agwedd ar ofal plant, gan gynnwys diogelwch, bwyd a diod ac amddiffyn plant. Ceir 24 o Safonau Gofal Dydd Llawn yng Nghymru. Bydd gan y lleoliad bolisïau a gweithdrefnau sy'n ymdrin â'r holl safonau hyn. Gallai peidio â dilyn y polisïau a'r gweithdrefnau hyn osod plant ac oedolion eraill dan risg, a gallent olygu bod y gweithiwr gofal plant yn cael ei ddisgyblu, a gallech golli eich swydd.
