In general, it is essential that early years and childcare childcare workers respect confidentiality and keep all sensitive information confidential. This is essential whether in a early years setting, a care setting, school, the home and any other organisation dealing with children and their families/carers. Publishing personal information about children without due care may cause parents/carers to feel vulnerable and at risk of harm. As a result, they may be reluctant to share information with members of staff in case it is disseminated to others. If childcare workers gather personal information about children, their privacy needs to be respected. Others trust childcare workers to keep such information confidential. In dealing with personal information, the needs of everyone have to be considered carefully.
It is necessary to be aware of professional rules of confidentiality. Unfortunately, situations arise when childcare workers are expected to share information in order to protect the welfare of the child. They have a duty to do so. Any matters involving the safeguarding of children must be referred to a line manager or senior member of staff. It may be necessary to share some information with other professionals such as: the social services, the police or the National Society for the Prevention of Cruelty to Children (NSPCC). Only information essential for professionals to be able to offer a service for the benefit and welfare of the child and the parents/carers should be shared.
If parents/carers discuss confidential matters with childcare workers, it is important that they have been informed of the setting's confidentiality and child protection policy. They need to know that information they share may be shared with a line manager if the childcare worker feels that they should do so. Parents/carers need to know that childcare workers are entitled to breach confidentiality as they have a responsibility to consider the health and welfare of the child primarily. A copy of the All Wales Child Protection Procedures should be available in the setting for parents/carers to view and staff to refer to.
If parents/carers want to ask advice on a matter, it is suggested that they are referred to other workers. If they give certain types of private information, it will be necessary to explain that it cannot be kept confidential and that the information must be shared. A childcare worker may have noticed signs of unexplained physical harm or is concerned about a significant change in a child's behaviour. They may receive a valid explanation from the parents/carers but discussions should not be held with parents/carers if this could endanger the child in any way. The advice of social services must be sought in the case of any uncertainty.
Childcare workers must reconsider the rules relating to confidentiality if a child 'discloses' that they are being abused or have been abused in the past. The situation is the same whether sensitive information is received from children or parents/carers. This information must be shared with the line manager, and then with other agencies such as social services, the police or the National Society for the Prevention of Cruelty to Children (NSPCC). If a child shares information with a childcare worker, it must be explained that the information cannot be kept confidential. It might to tempting to allow the child to talk, without explaining the situation on confidentiality. Unfortunately, this would be poor practice as it misleads the child into thinking that the childcare worker is going to keep something confidential when they are unable to do so.

Mae angen iddynt wybod y gall gwybodaeth y maent yn ei rhannu gael ei rhannu gyda rheolwr llinell os ydy’r gweithiwr gofal plant yn teimlo y dylid gwneud hynny. Mae angen i rieni/ gofalwyr wybod fod gan gweithwyr gofal plant yr hawl i dorri cyfrinachedd gan fod cyfrifoldeb arnyn nhw i ystyried iechyd a lles y plentyn yn bennaf. Dylai fod copi o Weithdrefnau Amddiffyn Plant Cymru Gyfan ar gael yn y lleoliad i rieni/gofalwyr ei weld ac i’r staff gyfeirio ato.
Os bydd rhieni/gofalwyr eisiau gofyn cyngor ar rywbeth, awgrymir eu cyfeirio at weithwyr eraill. Os byddant yn rhoi rhai mathau o wybodaeth breifat , bydd angen egluro na ellir ei gadw’n gyfrinachol ac y bydd rhaid rhannu’r wybodaeth. Efallai y bydd gweithiwr gofal plant wedi sylwi ar arwyddion o niwed corfforol sydd heb esboniad neu’n bryderus ynglŷn â newid sylweddol mewn ymddygiad plentyn. Efallai y caiff esboniad dilys gan rieni/gofalwyr ond ni ddylid trafod gyda rhieni/gofalwyr pe byddai hyn yn peryglu'r plentyn mewn unrhyw ffordd. Rhaid gofyn am gyngor y gwasanaethau cymdeithasol os oes unrhyw ansicrwydd.
Bydd yn ofynnol i ymarferwr ailystyried y rheolau ynglŷn â chyfrinachedd os bydd plentyn yn ‘datgelu’ ei fod yn cael ei gam-drin neu wedi cael ei gam-drin yn y gorffennol. Yr un yw’r sefyllfa, boed yn derbyn gwybodaeth sensitif gan blant neu rieni/gofalwyr.
