This is the law for improving the well-being of individuals who need care and support, and carers who need support.

The Act changes the way individuals' needs are assessed and the way services are delivered – individuals have more of a say in the care and support they receive.

It also promotes a range of help available within the community to reduce the need for formal, planned support.

The Act has eleven parts:

  1. An introduction to the Act – This describes what well-being means.
  2. General duties – Ensuring that the well-being of individuals who need care and support and the well-being of their carers are being promoted.
  3. Assessing the needs of individuals – Ensuring that local authorities assess the needs of an individual for care and support and assess the needs of their carers.
  4. Meeting needs - Ensuring that local authorities make a decision about whether an individual or a carer needs support and decides what to do to meet those needs.
  5. Charging and financial assessment – Local authorities can charge for the care they offer and the Act provides guidance on who can be charged.
  6. Looked after and accommodated children – Local authorities have to ensure that there is enough accommodation for looked after children.
  7. Safeguarding – Ensures that everyone who works in health and social care and childcare knows that they have a responsibility to report any individuals at risk.
  8. Social services functions – Describes how social services functions should work within local authorities.
  9. Co-operation and partnership – This helps promote the close working arrangements of the social care services with the health services.
  10. Complaints, representations and advocacy services – Explains how individuals can complain about the support they receive from social or health care services.
  11. Miscellaneous and general – This brings together all of the points not covered in the other sections and includes information about how individuals in prison or in detention should be supported.
